All employees are required to have an up-to-date employment agreement, no matter when you hired them.

You must also keep these documents secure and be able to present them whenever an employee requests it. This is your responsibility alone.

Failure to meet these obligations can result in a $20,000 fine from the Ministry of Business, Innovation & Employment and may also lead to employment disputes that are difficult and costly to defend.

This is the name of the manager the employee reports to.

This is the position of the manager the employee reports to.

This is the job the employee has been hired to do. Keep the title simple, so it is easy to understand what the job is.

If you have hired someone new this is their first day of work and the date this agreement comes into effect. It must be a date in the future and you should allow at least 7 days for them to read and consider the terms before starting work.
If this agreement is for an existing employee, this is the date they started with your company. The agreement will come into effect in 7 days.

Permanent employment can be full-time or part-time, it is employment without an end date.
Fixed Term employment has a start date and an end date. It is used for projects that have a completion date or for covering long term absences such as maternity leave. It can also be full-time or part-time.
Casual employment is work that has no fixed hours per week, hours change as business needs change, the work is defined as "AS REQUIRED". Casual employees receive an additional 8% on top of their pay for leave.

Fixed term employment must be for a genuine business reason. It cannot be a trial period. Common reasons for fixed term employment include: maternity leave cover or project work with an expected end date.

This is the end of the fixed term, on this date the employee's employment in this position will end.

Usually anything from 37.5 - 45 hours per week is considered full-time and anything less is considered part-time.

What is the dollar amount you intend to pay for this position and is it reflected as an hourly rate or annual salary? Any rate of pay must be above the New Zealand Minimum Wage, which is currently: $13.50 per hour for adults. Casual employees receive an additional 8% on top of their pay for leave.

The day or date of the week, fortnight or month that the employee will be paid.

This can include an annual bonus, company car or mobile phone with personal use. You do not have to write these things into the employment agreement, if they are tools of trade or one-off benefits that may not be repeated (such as a Christmas bonus). If you make it part of your employment agreement, you have an obligation to provide it.

This is the amount of notice that an employee must give if they resign, it is also the amount of notice you must give in some cases of termination, other than summary dismissal. The two most common ways of determining the notice period are, either:
1) The same as the pay period (weekly, fortnightly or monthly); or
2) Four weeks for salaried employees and two weeks for hourly wage employees.
